terms and services

This page outlines the Terms of Service for using Nice Design Store's website and working with us as a client. These terms contain important information about your legal rights and responsibilities.

By using our website or engaging our services, you agree to these terms. To make this easier to understand, we’ve kept the language as clear and straightforward as possible. This document is meant to ensure transparency, set expectations, and protect both you and us as we work together.

At Nice Design Store, we believe in building trust through clarity and transparency. The following terms are here to guide how we work together, define expectations on both sides, and outline the standards we hold ourselves to when delivering creative and digital services.

We encourage you to review these terms carefully and reach out if you have any questions before starting a project with us.

1. Eligibility

To use our services or access our website, you must be at least 18 years old or the legal age of majority in your jurisdiction. By engaging with us, you represent and warrant that you meet these requirements and are fully capable of entering into a legally binding agreement.

2. Description of Services

Nice Design Store offers a range of creative and digital services, including but not limited to:

  • Branding and graphic design

  • Website design and development

  • Content creation for social media, blogs, and advertising

  • Social media management and strategy

  • Event videography and video content production

  • Podcast planning, production, and editing

  • Google Ads management and digital advertising campaigns

Each project or service is tailored to the individual needs of the client and is subject to a separate written agreement, which includes the scope of work, timeline, and pricing.

We reserve the right to modify, suspend, or discontinue any service at any time, for any reason, without prior notice.

3. Client Responsibilities

To ensure we can provide the best possible service, we expect our clients to:

  • Provide timely and accurate information, materials, and feedback

  • Be responsive during the project timeline to prevent delays

  • Make decisions and approvals within a reasonable time frame

  • Respect our intellectual property and the agreed scope of the project

  • Abide by the agreed number of revisions and avoid excessive or out-of-scope requests without a formal update to the agreement

Failure to meet these responsibilities may result in delays, additional charges, or suspension of work.

4. Payment Terms

All payment terms will be outlined in your proposal or service agreement. Standard terms include:

  • A non-refundable deposit is required to begin any project

  • The remaining balance is due upon project completion and before final files or deliverables are handed over

  • For ongoing services (e.g. monthly retainers), invoices are issued at the beginning of the billing period and due within 7 days unless otherwise agreed

Payments can be made via bank transfer, PayPal, credit card, or other approved payment platforms. Late payments may result in service delays, late fees, or suspension of services.

In the event of non-payment, we reserve the right to withhold deliverables and remove access to any digital work or accounts managed by us.

5. Revisions, Changes, and Scope Adjustments

Each service includes a specified number of revisions as detailed in your agreement. These revisions are intended to fine-tune and enhance the final output, not to completely redesign or overhaul the original concept.

Any change that significantly alters the original scope (such as requesting new deliverables, features, or formats) may require a new proposal, updated timeline, and additional fees.

We aim to be flexible, but clarity on scope helps us maintain high-quality standards and timely delivery.

6. Ownership and Usage Rights

Once the final payment has been made in full, you will own the rights to the final, approved deliverables created for your project. This includes logos, graphics, videos, websites, and other design assets, as applicable.

Please note:

  • Rights only apply to the final versions, not drafts or unused concepts

  • Source files (e.g. PSD, AI, or raw footage) are available upon request and may be subject to an additional fee

  • We retain the right to showcase completed projects in our portfolio, social media, and marketing materials, unless you specifically request otherwise in writing before the project starts

7. Cancellations and Refunds

You may cancel your project at any time by providing written notice. However:

  • Deposits are non-refundable

  • If cancellation occurs after work has started, you will be invoiced for work completed up to the cancellation date

  • No refunds will be issued once final files or deliverables have been shared

We reserve the right to cancel a project due to lack of communication, failure to meet payment terms, or breach of agreement by the client.

8. Third-Party Services and Tools

Many of our services involve third-party tools and platforms, such as:

  • Website platforms like Wix or WordPress

  • Design tools like Canva or Adobe Creative Cloud

  • Ad platforms like Google Ads and Meta Ads

  • Social media platforms like Instagram, Facebook, LinkedIn, or TikTok

  • Podcast hosting and streaming services

While we help set up and manage these tools, we are not responsible for any issues caused by third-party platform updates, outages, limitations, or policy changes. You may also be required to maintain your own accounts and subscriptions for these tools.

9. Confidentiality

We respect the confidentiality of your business and ideas. Any materials, information, or trade secrets shared with us during a project will remain confidential and will not be shared or used outside of your project without your consent.

We also ask that you respect the confidentiality of our internal processes and not disclose proposals, pricing, or strategy documentation without written permission.
